It seems that Michael Jackson may be facing another trial for abuse. This time not abuse of a person, but abuse of celebrity status.
Ironically this case stems from Jackson's appearance, or rather non appearance, in court on molestation charges in February 2005.
Jackson, in February 2005, missed a day in court and checked himself into Marian Medical Center (Santa Barbara) complaining of flu type symptoms.
The complaint alleges that Manuela Ruiz, who had been admitted to the hospital earlier in the day from a heart attack, was removed from her bed in a hospital Trauma Room. This room was then used by Jackson.
The complaint goes on to allege that relatives and friends of Manuela Ruiz were first ejected from the room, then (at the insistence of Jackson's security team and hospital staff) were forced to wait in the Emergency Waiting Room for 20 minutes.
Manuela was relocated to a room with no medical equipment; an Eye, Ear, Nose and Throat Exam Room.
Manuela had a second heart attack, and died later that evening.
Jackson was removed from the Trauma Room to the empty Pediatric Unit.
The complaint alleges that Jackson's medical records, "will show that his purported "symptoms" not only did not require his placement in the Trauma Room, but that he should not have been admitted to the Hospital at all."
The family of Manuela Ruiz is suing Michael Jackson, the Marian Medical Center, Catholic Healthcare West, and 100 unnamed defendants, for unspecified emotional damages, related to Intentional Infliction of Emotional Distress, Negligent Infliction of Emotional Distress, Elder Abuse, False Imprisonment and Conspiracy.
No claim of Wrongful Death or Professional Negligence (or Medical Malpractice) is being made against the hospital, and no claim is being made regarding any cause or contributing factor Jackson might have had to the death of Manuela Ruiz.
Will this bring her back from the dead?
