Civil Case May Not Happen

The civil case against Michael Jackson and Marian Medical Center may not happen, according to the defendant's lawyer.

The family of Manuela Ruiz (a 74 year old at the time of her death) alleges that she was pushed out of her hospital room, in order to make room for Jackson in 2005. Ruiz later died.

Maria Ortiz, along with Rosa and Marcos Meraz, are suing over what they say was preferential treatment.

However, the plaintiffs did not appear in court on Monday. The hospital's lawyer says that they have not secured a lawyer.

A statement released by the hospital to Action News says:

"Patient care and safety is always our first priority at Marian. We have always been confident the care provided to Mrs Ruiz was exceptional. We continue to express our sympathy to the Ruiz family."

Suit Stopped

A lawsuit filed by the family of Manuela Gomez Ruiz, who died at a hospital soon after she was moved to make room for Michael Jackson, has been stopped by Judge Rodney Melville.

The Ruiz family had sued Jackson and Marian Medical Center in Santa Maria, claiming that she was kept from critical care after she had a heart attack on the same day Jackson was brought in with flu-like symptoms during his 2005 child-molestation trial.

Judge Melville on Tuesday allowed challenges to the complaint filed by attorneys for Jackson and the hospital, who had argued the facts of the case didn't justify the complaint.

Melville has given the plaintiffs' attorney, James McKiernan, 30 days to redraft their complaint.

The original complaint cites the "outrageous, circus-like atmosphere they orchestrated during the last hours of Manuela Ruiz's life and its obvious emotional and mental lasting effects upon the plaintiffs."

Michael Jackson To Be Sued For Abuse

It seems that Michael Jackson may be facing another trial for abuse. This time not abuse of a person, but abuse of celebrity status.

Ironically this case stems from Jackson's appearance, or rather non appearance, in court on molestation charges in February 2005.

Jackson, in February 2005, missed a day in court and checked himself into Marian Medical Center (Santa Barbara) complaining of flu type symptoms.

The complaint alleges that Manuela Ruiz, who had been admitted to the hospital earlier in the day from a heart attack, was removed from her bed in a hospital Trauma Room. This room was then used by Jackson.

The complaint goes on to allege that relatives and friends of Manuela Ruiz were first ejected from the room, then (at the insistence of Jackson's security team and hospital staff) were forced to wait in the Emergency Waiting Room for 20 minutes.

Manuela was relocated to a room with no medical equipment; an Eye, Ear, Nose and Throat Exam Room.

Manuela had a second heart attack, and died later that evening.

Jackson was removed from the Trauma Room to the empty Pediatric Unit.

The complaint alleges that Jackson's medical records, "will show that his purported "symptoms" not only did not require his placement in the Trauma Room, but that he should not have been admitted to the Hospital at all."

The family of Manuela Ruiz is suing Michael Jackson, the Marian Medical Center, Catholic Healthcare West, and 100 unnamed defendants, for unspecified emotional damages, related to Intentional Infliction of Emotional Distress, Negligent Infliction of Emotional Distress, Elder Abuse, False Imprisonment and Conspiracy.

No claim of Wrongful Death or Professional Negligence (or Medical Malpractice) is being made against the hospital, and no claim is being made regarding any cause or contributing factor Jackson might have had to the death of Manuela Ruiz.

Will this bring her back from the dead?

More Legal Woes

It is reported that the family of a woman who died after being moved out of a trauma room, to accommodate Michael Jackson when he had his "flu like" symptoms, plans to sue both the hospital and Jackson.

Manuela Gomez Ruiz, 74, was transferred out of the main trauma room at the Marian Medical Centre in Santa Maria when Jackson was rushed in last week.

Her family claim that she was taken off a machine ventilator, and her breathing was instead assisted manually by a handpump.

It is reported that Mrs Ruiz was being treated after having a heart attack, but suffered two more that day before she died.

Her daughter-in-law, Anna Ruiz, told reporters that she saw Jackson come into the emergency unit. She said:

"He walked in...When I saw him, he was walking unassisted."

Mrs Ruiz's daughter, Maria Elena Ortiz, who was also in the hospital objected when her mother was moved.

The family claims that the chaos caused by Jackson's arrival distracted staff. They said equipment had to be crammed into the smaller room, and they were limited to two visitors at a time.

Jackson's publicist, Raymone Bain, has issued a statement saying:

"Michael Jackson sends his condolences to the family of the deceased...However, it is outrageous that Michael Jackson's name would be invoked into a situation of which he had no authority or control. It appears that ABC is deliberate in its attempt to circumvent Michael Jackson from receiving a fair trial."

Flu Stops Trial

Michael Jackson was taken to hospital yesterday, vomiting and suffering from a "flu-like illness"; consequently his trial has been put on hold.

Seemingly Jackson became so sick en route to court, that he was driven instead to a local hospital. The sudden illness came as a surprise to the judge, and the defence/prosecution teams.

The defence lead, Tom Mesereau, said:

"I did speak with Mr. Jackson by telephone this morning on the way to court and he said he was very ill... I'm told he's being examined by a doctor..."

Over 100 potential jurors idled away an hour while the judge conferred in private with prosecutors and Jackson's attorneys and then, by telephone, with an emergency room doctor.

Judge Melville emerged from his chambers to announce that Jackson had been admitted to the hospital, and would not be able to attend court until next week. It is reported that the potential jurors let out a collective groan at this juncture.

I suspect that the initial buzz of attending a showbiz trial may soon wear off, as the tedious procedural realities of the lengthy court case dawn on them.

Needless to say the reporters covering the case all made a dash to the Marian Medical Center, where Jackson is being treated.

Dr. Chuck Merrill said:

"Mr. Jackson has been evaluated in our emergency department for a flu-like illness with some vomiting.."

Seemingly Jackson is in a stable condition.
